Monica Moisin - Cultural Intellectual Property & Fashion Lawyer, Cultural Sustainability Systems Weaver
A lawyer for your fashion business
I am a Cultural Intellectual Property & Fashion Lawyer and Cultural Sustainability Systems Weaver with 10+ years of experience internationally.
I work at the intersection of law, fashion, intangible cultural heritage related to Traditional Knowledge (TK) and Traditional Cultural Expressions (TCEs) and biodiversity.
I am the author of the TEDx Talk: “Cultural Fashion: Transform the Fashion Industry From Villain to Hero” and founder of the Cultural Intellectual Property Rights Initiative® (CIPRI) and WhyWeCraft® - a constellation that enables systemic-change in fashion and law through its programs and services.
I have specializations in EU law, international arbitration, and textile value chain management with expertise to advise on various Intellectual Property matters from trademark and design registration to drafting licensing agreements and managing IP portfolios, representation and assistance in alternative dispute resolution procedures, to designing innovative legal solutions that respect Indigenous and Local Knowledge.
I proposed a soft law framework - The 3C’s Rule: Consent. Credit. Compensation© - for sustainable, fair and equitable relationships between creative industry stakeholders and Traditional Knowledge Custodians (incl. craftspeople) who belong to Indigenous Peoples, Ethnic Groups and Local Communities. Created in 2017, this framework now guides best practices in the fashion industry, is included in the curricula of fashion education institutions, and informs national and international policy developments.
I design workshops, talks and lectures and support projects with legal consulting and cultural sustainability strategy. I work with the UN Convention on Biological Diversity and the World Intellectual Property Organization.
I am a member of the WearSustain Network, a One Young World Ambassador, Top 40 Under 40 EU-India Leaders Awardee (2019).
I speak English, French, German, Spanish and my native Romanian.
